Philadelphia Sued by Children’s Health Defense

The City of Philadelphia, the Philadelphia Department of Public Health, and Commissioner Cheryl Bettigole were served court summonses on Wednesday this week for violations of federal, state, and constitutional law.

The complaint, CHD v. The City of Philadelphia, takes aim at a 15-year-old regulation promulgated by the PDPH to allow children over the age of 10 to consent to vaccinations without the knowledge, approval, or presence of their parent or legal guardian. The PDPH amended the regulation to allow children to add the Emergency Use Authorized Only COVID shots in 2021.  CHD is representing seven parent plaintiffs in this case.

Philadelphia’s Minor Consent to Immunization Regulation flies in the face of informed consent, freedom of religion, parental rights, and due process and demonstrates a level of recklessness that has become an ever-increasing pattern with this “public health” agency. Children throughout the Philadelphia region were flooded with misinformation and propaganda extolling the COVID shots as “lifesaving,”, “100% effective,” and necessary to visit elderly loved ones.

During the COVID crisis, health professionals and the media and politicians that parroted them repeated bold lies they must have known could not be true. There are thousands of examples like this one from Dr. Susan Coffin, from the division of infectious diseases at the Children’s Hospital of Philadelphia, who told Philly Media that “the vaccine is proven to be safe for adults and children ages 12 and up” These propaganda campaigns targeted children and created, overnight, intense environments of peer pressure on children to get these shots or face social ostracism.

The regulation had largely remained hidden from the public for fifteen years until discovered by PA CHD through an article promoting this regulation appearing in the news blog of WHYY. Besides having never been presented for public comment or review, this regulation, when approved by the city’s legal office, was never announced to the public but quietly distributed to the city’s public health centers and pediatric physicians in the city.  Only during the intense call on children to line up for these dangerous shots did this regulation receive any public exposure.
